May 2025 Can a Court Raise an Award? A recent decision from the Second Judicial Department of the New York Appellate Division held that a plaintiff's award could be raised. The plaintiff appealed from a 2021 decision of the Queens Supreme Court awarding him $100,000. The case stemmed from the plaintiff The plaintiff becoming injured after slipping and falling off a chain-link fence on June 17, 2019.
The case was based on personal injury resulting from alleged violations of violations of Labor Law ยงยง 200, 240(1), and 241(6), as well as ordinary, common-law negligence. The award was raised from the principal sum of $100,000 to $400,000, holding that the figure deviated materially from what would be considered reasonable compensation for the damages.
